If theres neglegence involved by any defendent Lots of waivers are Null and Void! Tossed out.
But this New ruling makes it crystal clear that No waivers for minors will be legally binding in the state of florida.
That will certainly lessen the sports event for the minor children/kids. mike

I see one big problem overlooked in the ruling mainly with the statement: "Therefore, when a parent decides to execute a pre-injury release on behalf of a minor child, the parent is not protecting the welfare of the child, but is instead protecting the interests of the activity provider.” And that problem is, by the parent signing the waiver, it allows the minor the benefits of participating in the actvity. It is not a one sided agreement. If the judge's ruling stands, then the law needs to be changed. Last week I signed a waiver for my minor at Skip Barber racing school, and likely I will again on Sat at Sebring, be interesting to see if they have noticed this recent ruling. ![](/ubbthreads/images/graemlins/Twocents.gif)

Waivers are I believe usually required by the sites attorney, the sites insurer, and as an intimadating bluff to try and scare off frivilous lawsuits. Money isn't the key concern, giving permission to someone to participate is, and usually by collecting money from someone, it implies permission to participate, but then I am staying at a motel 6 tonight ![](/ubbthreads/images/graemlins/image_294343.gif) And this ruling as it stands is a big deal, and will have far reaching ill yet to be seen effects on kids unfortunately.
