Something for all you Fla racers need to keep an eye on.
Just bikes now but no telling what can follow. Might
need to be contacting your Senators and Representatives.
And everyone else to watch. Usually when one state
starts the others follow.

Since persons under the age of 18 can't legally sign a binding document, goodbye to racing for kids in the state of FL.

yep, them too. they probably figured they had no chance of any payoff until some sleazy lawyer told them that there is a way to make that waiver they signed null and void

If theres neglegence involved by any defendent Lots of waivers are Null and Void! Tossed out.

But this New ruling makes it crystal clear that No waivers for minors will be legally binding in the state of florida.

That will certainly lessen the sports event for the minor children/kids. mike

This could conceivably be applied to ANY type youth sports, not just youth motorsports.

I see one big problem overlooked in the ruling mainly with the statement:

"Therefore, when a parent decides to execute a pre-injury release on behalf of a minor child, the parent is not protecting the welfare of the child, but is instead protecting the interests of the activity provider.”

And that problem is, by the parent signing the waiver, it allows the minor the benefits of participating in the actvity. It is not a one sided agreement. If the judge's ruling stands, then the law needs to be changed.

Last week I signed a waiver for my minor at Skip Barber racing school, and likely I will again on Sat at Sebring, be interesting to see if they have noticed this recent ruling.

Waivers are pretty much toilet paper to start with. All they do is guarantee a lawsuit if something happens.

I wonder if it would matter if no money was collected for the kid races, or is it just what, and where they're doing it?

Waivers are I believe usually required by the sites attorney, the sites insurer, and as an intimadating bluff to try and scare off frivilous lawsuits. Money isn't the key concern, giving permission to someone to participate is, and usually by collecting money from someone, it implies permission to participate, but then I am staying at a motel 6 tonight

And this ruling as it stands is a big deal, and will have far reaching ill yet to be seen effects on kids unfortunately.

I also wonder what happens to field trip permission slips and so on, and everything else we sign as parents for activities that don't directly benefit then, but do expose them to some potential harm.
