SO I bought a 6.4 BGE from a place in michigan and they shipped it to me through R&L and now it is 11 days late and tracking has not been updated in 14 days, it was sposed to be here on 3-4-22 last update on tracking number was 3-1-22 in denver, on the 7th I called them they said it would be there that day (every day since the 4th tracking showed it would be here that day) so no worries a couple days late, still didn't show up I called them last thursday and they said it was in salt lake city, waited till yesterday to get no update so I called again and he said it was in denver WHAT IN THE WORLD??? said it would be on the next truck the next day, still no tracking update, called today and they are saying Merganthaler had it last in denver, called merganthaler and they can't find it but do admit they received it 3-1-22 so where do I go from here? Is this on the place I bought the engine? R&L carrier? Merganthaler? Do I file a claim with one (witch one?) and get one of them to buy me a new engine and cover the shipping I paid for? I fail to see how they can just lose an engine, someone on the dock should see it sitting in the way or maybe it got to salt lake city and realized someone didn't close the door on the trailer or something...
I am not causing global warming, I am just trying to hold off a impending Ice Age!

It's on the carrier, once they sign BOL showing they picked it up they responsible for it till you sign the delivery receipt. I know I work for an LTL carrier. Push the issue. Tell the shipper you are going to cancel payment so they get involved.

carnut 68 and others are on the right track. The seller should file a claim with the Shipper who is responsible for the product until it is signed for at its destination. Since the seller hired the shipper, it is on them to initiate the claim. It is on you to inform the seller that the product has not shown up- that's really about it. In my world, we wouldn't make the buyer file the claim as we have all the info in front of us and are paying for the shipping. Also, you purchased from the seller for an agreed value. What they chose to insure it for is their business- they owe you the product - or a refund. What occurs between the seller and shipper is not your issue. Agreed as the shipper has the contract with seller, not buyer. You as a buyer have ZERO standing in that contract. Only thing that would sway it is a FOB shipping point vs Destination on BOL. Then the responsibility flip with different designation.

Well the shipping company R&L Carriers handed it off to MTS freight in denver then it disappeared. Neither shipping company will allow me to file a claim though they both claim it is standard procedure and easy to do but the company who shipped it will have to file, the shipper is M-97 auto parts in Warren Michigan and for some reason they keep blowing me off and will not file the claim! Anyone on here familiar with them? Maybe willing to go down in person and ask em to get this thing rolling?
I am not causing global warming, I am just trying to hold off a impending Ice Age!

I’m guessing you didn’t pay with a credit card?
If you did, it would likely get the claim situation moving if you disputed the charges.

They are probably blowing you off because they didn't pay for declared value Cargo insurance. Liability limits under a standard bill of lading is $2.00/lb shipping weight unless declared otherwise. If you paid more than that for it, they might want to wiggle out of a refund of the difference. If filing a credit card claim is out, there is always wire fraud if the deal was done over the internet or paid for with a bank or postal money order. Kevin
