I don't see why it couldn't still have a performance tune done on it.

That is of course as long as it doesn't eliminate the computer update/flash.

The U61 reprogram is about the cruise control.
https://static.nhtsa.gov/odi/rcl/2018/RCRIT-18V332-2370.pdf

The fault handling strategy of the Powertrain Control Module (PCM) software on
about 1,574,200 of the above vehicles does not remove positive torque requests
from the engine controller if the CAN-C bus stops communicating while the cruise
control is requesting positive torque. In the instance of a short in the vehicle
causing the CAN-C bus to stop communicating while the cruise control is active
and the vehicle speed is below the set speed such that the cruise control system is
requesting positive torque at the exact moment of the short, it is possible for a
positive torque request to be locked on the PCM which may result in either the
vehicle maintaining its current speed or possibly accelerating. If the driver does
not shift to neutral or apply the brakes to stop the vehicle this condition can cause a
vehicle crash without warning.

update

i went to see it today, and the saleman said it had already been tuned, but he had no details. he also said it had a 4.10 gear so it would have to have the speedo calibrated. 41000 miles so it was probably someones toy, should i make it my toy? would you buy a vehicle that has already been tuned? i will see if mich will let me do a title search and maybe i can find the person who tuned it or is there a better way?

If you want to get custom tunes you have to get a jailbroken pcm anyways. You could still put on something like an edge pulsar inline tuner with no issues.

If HP tuners support the computer then you can buy the credits and tune any OEM computer. Credits price vary per computer but $50.00 and you can tune it as much or as many times as you want. Once you buy the link equipment around $400.00 jot only can you tune and flash your computer, the tuner is also a scan tool and data recorder. Turn off check engine lights, check sensors etc.
