My sister was a Paralegal for an insurance company and was involved in many cases. She became frustrated with true victims getting the shaft while people gaming the system would get offered settlements from companies who didn't want to fight in court.

Re: Any PERSONAL INJURY lawyer stories ? - 06/01/20 08:39 PM

A good long time friend of mine had a story from decades back. His 3 year old daughter started getting sick. It was late in the week and the Dr's office nurse heard the symptoms over the phone, said the Dr's are out, wait until Mon, give the child some pain medication and call us on Monday. Their insurance at the time has some seeing Dr restrictions so they sat tight. Sat night she got worse, so he took her to ER, the ER said this is more serious then they could handle, transported her to Pediatric Hospital. I visited that Hospital Mon Night, it looked serious, not sure the parents understood how so. I called my RN wife at the time, and wanted her to drop by hospital ASAP, she did on Tuesday, I donated Plasma for the child on Wed, she died Wed night.

The parents took the loss of their second child pretty hard. It sucked. They after awhile thought they had a valid legal malpractice case. I knew they were in over their heads when they both bought mid priced new cars and were looking at McMansions. One day he called me crying said he had been screwed. His wife evidently had signed paperwork in the beginning that the lawyers had full rights to settle, and the lawyers did, and after the lawyers cut, and all the "expenses"(BS inflated) They got nothing more. They eventually broke up and got divorced. The ex wife a few years later died of the same condition, a blood disease. My friend ran a lawn service business, he was always for years harping on how useful Round-up was for his line of work..

All those lawyers cherry pick unless they are desperate. So if the "For The People" lawyers take your case then you are pretty certain to win something. They know what they can win and what is risky. That firm didn't get to be the largest personal injury firm in the country by taking losing cases.

I don't know about Jack but I know the other one. He's a raging liberal, hosted Obama and held high dollar fund raisers for him BUT, he did fund the medical marijuana fight in Florida and it is now legal here so I give him credit for that.

FWIW, There are 54? counties in Florida, Broward is like now the 5th? population wise largest.

I heard a number of years back, there are more lawyers in Broward County, then all of Canada.

Not sure who exactly that means is the winner here on that topic. eek

OT, my personal lawyer in Florida for decades IMO is rather conservative. He has selfies from decades hanging in his office with EVERY conservative player there ever was for that last 30+ years.

I took to heart when he mentioned one he will not work for, as he likes to get paid, who will remain nameless.

He also told me, he will defend me to my last dollar. work

You would never get that without an attorney.

Re: Any PERSONAL INJURY lawyer stories ? - 06/02/20 03:47 PM

In Nevada the personal injury lawyers generally take 1/3 of the "winnings" in the beginning. After there is a lawsuit or trial, the rate often goes up to 40% or 50%. The lawyer takes his percentage first, then all the experts and bills are paid, and then the Plaintiff gets anything left overt. The second biggest racket is the medical bills. Most folks have medical insurance or medicare/medicaid. The lawyers tell their clients not to use insurance. Rather, go to the doctors the lawyer recommends who will do the work on a lien (the doctor gets paid when the lawsuit is over). That way your epidural can cost $15,000 instead of $700 and the inflated medical bills help get an inflated settlement or verdict. Its a great money machine!

I understand, however my take, he was honest, he is only in it for the money, and an honest lawyer, is a rarity in my book.

This is not the case in my experience. your health insurance can be used but once legal responsibility for the injuries has been established your insurance needs to be reimbursed. The exact terminology escapes me at the moment. A good PI lawyer will negotiate your liability with the service providers and insurance company for you.

The term for the reimbursement process is subrogation.

They are snakes and alot of the litigation seekers are poor broke as heck people that "got to get paid".

I dont think a legit case needs a head hunter in the mix getting rich on the ride.

A good "normal" respected attorney would be more in order.

I might be wrong, but on my tv all I see boasting about there big settlement is inner city folks that talk and act like they are already on the gov. free money train. AND some even have the nerve to say ots there second time with the same head hunter attorney.

Every American ought to thoroughly know the history (soap opera) of P.I. lawyer
John Edwards
Of North Carolina

https://en.wikipedia.org/wiki/John_Edwards

Quite an eye opening story.

He could have easily become Vice President or even President.
Thank goodness he did not.

His deceased wife and older daughter have proven themselves of quite better character.

Re: Any PERSONAL INJURY lawyer stories ? - 03/07/22 07:40 PM

It isn't easy to find a good lawyer now. Most of them want to get money from the client but are not ready to work. My nephew had an accident three months ago. The insurance company and the lawyer from the insurance company claimed that my nephew would not achieve any insurance payments. As far as I know, Michael turned to lawyers from the website sutliffstout.com. And they achieved not only insurance payments but also compensation for the funds spent by the nephew on court expenses.

Re: Any PERSONAL INJURY lawyer stories ? - 03/12/22 12:09 AM

During the 1990s I was a claims manager for a large trucking company. I got a call from one of our drivers to report he had a wreck with a small passenger car. He had exited the interstate and was sitting at the end of the ramp, waiting for cross traffic to clear so he could make a right turn onto the cross road. Unknown to our driver the small car came up on his right side, completely on the shoulder. Since the cab was already turned, our driver could not see the car in his big mirrors, so he progressed through the turn and ended up hitting the left front corner of the car, which was driven by a 20-something female. No tickets were issued but the cop investigating the wreck said our driver should have seen the car. Forget that the car should not have been where it was.
Our insurance adjuster went to the scene and said the damage was very light and estimated damage at $1000. It was an old Toyota. The VP in my department wanted the wreck to go away, and because the car was occupied, I offered $1500 for a full and final release.
By that time, the woman's father showed up and refused the offer. He went to an ambulance chaser, hoping to get more money.
I got a call the next day from the attorney and he settled for $2000.
Even though it was more than I initially wanted to pay, I had to laugh about the deal because after the attorney took his percentage, I have no doubt the driver of the car ended up with less money than I initially offered.
