It could be but without proof (original fender tag, or Broadcast Sheet) there's no way to know for sure, especially on a restored car. It has a black Shaker Bubble which would typically be incorrect, should be red or Silver Argent.

He had the fendertag on the ebay auction, see it is gone now. At least it wasn't a factory 340 n96 dana car

I have pictures of this car before it was sold from Rochester MN. listed for $54,900 I am trying to post them from Autabuy but can't seem to to get it done

Gil,
I did speak with the owner selling it the first time I saw it and he sent me the 1st fake tag,which I reported to the fender tag police.
The owner on ebay that was selling it now, which I also was in contact with by emails did not want to hear what I had to say
I still only know of 3 70 340 shaker cars

WOW! I just got off the phone 
with the 3rd seller now.I tried to explain in a very nice and discrete
way that we know about this cuda.I let him talk and it seems that he is not a Mopar guy,but still I finally said the shaker was added and something is wrong with the Fender Tag.I don't think he got it
