What would you rather do? mill the indy 440-3 intake down or lower the motor some.... I need to go down about 3/8ths

I am guessing that you mean from the top of your air cleaner... if you have enough air filter that the engine can breathe then all you need is JUST clear (if you dont have any frame twist) a 1/4 " should work

Well if the trans has a rubber mount I would unbolt the motor mounts and lower the K then look to see if there is any angle at the motor mounts when you bolt then back up, if there is any angle change then add a shim to the motor mounts. Basically you would be pivoting the engine down from the trans mount forward to the motor mounts. The tailshaft will raise up on the ratio of difference between the 2 points
